Following the modernization in June 2000 of its corporate regime, Spain became a fiscally attractive location in which to base a holding company. Spanish corporate law shares many similarities with the legislation of many Latin American countries. Spain offers a broad tax treaty network with Latin America combined with the European character of the Spanish holding regime.

This effectively creates an appealing route for channeling capital investments towards Latin America, as well as for efficiently retrieving EU capital investments by non-EU companies. Consequently, Spain is not on any Latin American blacklist.

The Spanish holding regime, Entidades de Tenencia de Valores Extranjeros (ETVE), offers many of the same advantages as other EU holding regimes. One of these is a flexible limited liability vehicle specifically designed to avoid the creation of harmful tax competition as defined by the European Commission. This regime is of particular interest to international investors active in Latin America and to Latin American investors active in Europe, the United States and the Far East.
